Bishkek, Nov. 20, 2020 / Kabar /. Sadyr Zhaparov, being Acting President, signed a decree on pardoning 230 prisoners, the press service of the State Service for Punishment Execution.
The department explained that according to the requirements of the Constitution of the Kyrgyz Republic, pardon is carried out only by the president in relation to an individually defined person. The act of pardon is adopted by a presidential decree sent to the respective convict, in respect of whom the petition was made. If the petition for pardon is rejected, the president issues a formal decision.
Petitions for pardon of persons sentenced to imprisonment are submitted to the president for consideration if there are proposals from the Commission on the application of pardon to convicted persons. If the Commission finds no grounds for proposing a pardon, the information is presented to the president, and the applicants are informed of the rejection of requests for pardon.
A pardon act can replace a life sentence of imprisonment for a term of twenty years, and also mitigate the sentence of imprisonment by a certain term, except for cases when a court has applied a punishment with the use of probation supervision or parole from punishment.
A repeated petition for pardon of a person sentenced to life imprisonment in the absence of new, noteworthy circumstances, may be submitted after ten years, and a person sentenced to imprisonment for a certain period - after half of the sentence imposed by the court.
The State Service for Punishment Execution has sent more than 1,800 requests for clemency to the Secretariat for Pardons under the President of the Kyrgyz Republic.
Today, according to the decrees of Acting President of the Kyrgyz Republic Sazhyr Zhaparov on pardon, 230 people were released from places of imprisonment, the terms for 38 convicts were reduced.
