Kyrgyzstan celebrated the Constitution Day on May 5. The main document of the country turned 29 years. The Constitution of independent Kyrgyzstan was approved in 1993. For more than a quarter of a century, the Constitution has changed along with the country. Amendments and changes have been made to keep the document up to date. The last change to the Constitution took place a year ago, the referendum on changing the Basic Law was held on April 11, 2021. More than 79% of those who came to the polls voted for the changes. The head of state also signed the relevant Law of the Kyrgyz Republic “On the Constitution of the Kyrgyz Republic”.
“The draft of a new Constitution is the beginning of a chain of reforms,” experts have said a year ago, in addition to the president. Now, a year later, one can observe what changes are taking place in the country. There is a reform of state bodies, ministries, domestic and international projects are being implemented. The last major change is the increase in the salaries of civil servants, including teachers and doctors.
“Firstly, we will create the most favorable conditions for doing business. First of all, it will be protection against unauthorized inspections, interference, raiding and attacks. We will eliminate bureaucratic barriers, reduce the time for obtaining licenses and permits, and ensure the free circulation of capital. We will carry out a reform of the fiscal system aimed at improving management, simplifying and digitalizing procedures, reducing the tax burden and bringing businesses out of the shadows,” the president said last year.
Now one can observe the work done and note that the country is really going according to the plan. So, for example, the implementation of digital projects has led to the fact that the business has really reformatted and began to work more openly and transparently. Conditions for investors are being created, bureaucratic costs are being reduced. Changes in the financial and economic sectors led to economic growth at the beginning of the year, which was the first time since the start of the coronavirus pandemic.
The new Constitution also touched upon judicial reform. Now the election of judges will be more transparent, in addition, a more favorable platform has been created for strengthening the judiciary.
“As you all know, a major constitutional reform was carried out in our country last year, and a new Constitution was adopted in a popular referendum. The Constitution contains urgent tasks for our country, the values that we cherish as a people and the ideals that our society aspires to. Also, as part of the constitutional reform, 5 laws were initiated to regulate the judicial system, adopted by the Jogorku Kenesh. These laws have created favorable conditions for strengthening the independence of the judiciary,” said President Zhaparov during his speech at the 12th Congress of Judges.
Undoubtedly, last year's changes in the main document caused a number of criticisms. Now, a year later, we can already say for sure that the critics have disappeared from sight.
“To the recent criticism of the new Constitution and that such a decision was allegedly made in a hurry, I can say that I have studied many Constitutions of other countries. In many countries, it was adopted within 2-3 months. As for the fact that there will be a dictatorship, it is worth noting that it was the parliamentary system that led to the dictatorship. A multi-party system contributes to the establishment of a dictatorship. History also shows that parliamentarism contributes to a lag in development in many sectors,” said Muratbek Imankulov, member of the Constitutional Court, after the adoption of the new Constitution.
Today, President of Kyrgyzstan Sadyr Zhaparov congratulated the people of Kyrgyzstan on the Constitution Day. He noted that the current document will lead to significant changes in the state and legislative system.
“Throughout its centuries-old history, the Kyrgyz people have always stood up for truth, stood for justice, lived with the idea of a sovereign Kyrgyzstan, a strong, prosperous state. Today, the current Constitution of the country lays down the conditions for ensuring justice and equality. This was the result of the implementation of the requirements put forward during the October 2020 events. The first Constitution of independent Kyrgyzstan was signed on May 5, 1993. The new Constitution, adopted at a referendum in April 2021, was also signed last year on May 5,” Zhaparov said addressing the people of Kyrgyzstan.
The president emphasized that a year ago, by voting for the changes, people chose strengthening the country's independence, traditional family values, the rule of law and freedom.
“Thus, the people of Kyrgyzstan have made a choice in favor of the stability of the political system, the preservation of primordial traditions, and the provision of social guarantees. The main provisions of the current Constitution will reliably protect entrepreneurial activity, civil initiative and public life.
This Constitution will not only lead to significant changes in public administration and the legislative system, but will also create a legal basis for the rapid development of the country's economy, improve the living conditions of our citizens and strengthen statehood,” Zhaparov added.
In the conditions of the current world, the crisis, the coronavirus pandemic and other processes that have been the anchor of development in recent years, it is necessary to find ways out and adapt to realities. The development of the country depends on many factors, including the consciousness of citizens, the responsibility of state bodies, the activities of business, and the protection of the interests of society. The connecting link of all these processes, as well as the guarantor of the rule of law, is precisely the Constitution.
