Bishkek, Jan. 29, 2019. /Kabar/. The Government of the Kyrgyz Republic informed on further measures to form the Supervisory Board of the Institute of Business Ombudsman, the press service of the Kyrgyz Government Office reported.
Currently, an order of the Government of the Kyrgyz Republic on granting the Deputy Minister of Economy the right to represent the Government of the Kyrgyz Republic щт the Supervisory Board of the authorized person for the protection of the rights of business entities (Business Ombudsman) has been initiated, which is currently sent for approval to ministries and departments.
The composition of the block of international development partners is determined according to the results of consultations conducted by the European Bank for Reconstruction and Development (EBRD).
The EBRD is the main international partner in establishing the Institute of Business Ombudsman and agreed to assume a coordinating role in relation to the block of international development partners.
As for the block representing the interests of the private sector in the Supervisory Board – through business associations - it is assumed that five business associations will participate in this block on an ongoing basis and two business associations on a rotational basis.
For business associations that are members of the Supervisory Board on an ongoing basis, certain criteria have been established that are designed to select the most authoritative business associations representing the interests of the widest number of entrepreneurs.
The following criteria have been established for business associations applying for membership in the Supervisory Board:
- the largest coverage of business entities in the Kyrgyz Republic;
- the largest amount of tax payments made by members of a business association;
- at least 50 members paying membership fees of a business association;
- the term of operation is not less than 5 years at the time of the formation of Party 3 (a block of business associations in the Supervisory Board).
The Government Decree No. 647 on the Authorized Person for the Protection of the Rights of Business Entities (Business Ombudsman) was signed on December 31, 2018.
According to the document, as a matter of priority, the Supervisory Board should be formed – the collegial supreme governing body of the Institute of Business Ombudsman.
The Supervisory Board is in charge of issues without a decision on which it is impossible to start the activities of the Business Ombudsman. Such issues include election of the Business Ombudsman himself and his deputies, as well as the approval of the regulations of the Business Ombudsman – a document that will contain a more detailed procedure for the work of the Business Ombudsman.
The main principle of work of the Institute of Business Ombudsman is its independence. This means independence from both the state and business. This principle is realized in the work of the Supervisory Board.
The Supervisory Board consists of authorized representatives of three parties – the Government, business associations representing the interests of the private sector, and international development partners.
Key decisions, such as the election of the Business Ombudsman and his deputies, are made unanimously by all parties. Each party has one vote, regardless of the actual number of authorized representatives in the relevant block. Consequently, decisions are made when a full consensus is reached between these three main parties.
