In the near future, Kyrgyzstan will adopt a Strategy for Mediation Development in the Kyrgyz Republic for the period from 2022 to 2027. The Republican Community of Mediators organized a dialogue platform to discuss the new document.
The strategy aims to ensure that by 2027 the institution of mediation will become recognizable and in demand in society and the system of public administration. The event was attended by representatives of government agencies, including the Supreme Court, the Interior Ministry, the Ministry of Labor, the State Service for Punishment Execution, the Probation Department, international partner organizations, mediators from all regions, civil society and journalists.
In particular, the participants discussed priority areas of mediation development in the country, aimed at ensuring recognition of mediation as an effective mechanism for dispute and conflict resolution in society. The need to improve the legal framework and create conditions for institutional sustainability of the Republican Community of Mediators of the Kyrgyz Republic was noted.
Currently, mediation is recognized worldwide as the most important criterion for the development of democracy. It is one of the effective ways of settling disputes and a sign of a developed civil society, an indicator of a high level of legal culture and maturity of economic turnover.
According to the participants, Kyrgyzstan has all the necessary conditions for the development of the institution of mediation. For example, the country's main document, the Constitution, states that "the state shall ensure the development of extrajudicial and pre-trial methods, forms and means of protecting human and civil rights and freedoms" (Article 61 of the Constitution).
The National Program for the Development of the Kyrgyz Republic until 2026 emphasizes that it is the development of the institution of mediation that will lead to a significant unloading of the judicial system.
Gulsina Kozhoyarova, the founder of the National Mediation Center of the Kyrgyz Republic and Chairperson of the Supervisory Board of the Republican Community of Mediators noted that the further development of mediation requires the formation of a single policy document, which will show the prospects for the development of a new method of conflict resolution in Kyrgyzstan.
"At present, the demand for mediators' services is apparent - only in the first half of 2022, more than 1 thousand people applied to the Mediation Centers created at the courts and local self-government bodies of the republic. Each of them faced a conflict situation that required the help of a mediator.
It is encouraging to note that our mediators have been able to help victims in resolving their disputes. The figures show that family disputes often arise in our republic, with conflicts in civil cases, followed by economic and land issues. Also mediators often have to help in criminal cases. The cornerstone of stumbling blocks is that people do not know how to reach an agreement, sit at the negotiating table, and succumb to negative emotions, resentment and anger. The mediator's main task is to assist in the negotiation process and help come to an optimal solution for all parties," Kozhoyarova added.
The participants of the dialogue platform approved the Mediation Development Strategy. The next step will be the Conference of Mediators of Kyrgyzstan, to be held in the fall of 2022 in Bishkek, where this strategic document will be adopted and submitted to the Presidential Administration.
In developed countries, mediation plays an important role in dispute resolution, significantly reducing the burden on the judicial branch. In international practice, mediation is actively used both in the resolution of private disputes and international economic disagreements.
