Kyrgyz business lawyers discussed enforcement practices of interaction between business and state bodies in administrative procedures

Bishkek, Dec. 9, 2021 / Kabar /. Over 40 practicing corporate lawyers, arbitrators of the International Court of Arbitration and representatives of business associations discussed problems and learnt details of law and practice for administrative procedures, UNDP in Kyrgyzstan reported.

The discussions were held within the framework of the UNDP project " Integrating inclusive, people-centered and human rights-based approach frameworks into national legal, justice and post constitution-making processes " with Mr. Nurbek Sabirov, expert and partner of Kalikova & Associates Law Firm.

The expert Sabirov emphasized: "Yesterday and today the focus was on the problematic aspects of the practical application of the Kyrgyz Republic's Law on the Basics of Administrative Activity and Administrative Procedures No. 210 of 31 July 2015 in terms of the interaction between business and state authorities. The study shows that complaints are received from citizens and business entities, complaints are satisfied, but disciplinary measures are not taken. In order to encourage government agencies to apply this law more actively, we, the private sector, need to put forward efforts to apply the law as much as possible.”

In addition, the workshop discussed what should be included in the "Handbook for Corporate lawyers on Grievance Mechanisms in Administrative Procedures", which is being prepared for publication in 2022.

"This event is part of a UNDP project aimed at supporting businesses in access to justice. UNDP is providing technical support to analyse some problems in legal aspects of appeals in administrative procedures in order to develop recommendations for government and businesses to improve such mechanisms. Views and experiences of business lawyers were exchanged at the workshop. The workshop participants also suggested creating a platform to discuss the problems of appealing the actions and decisions of state bodies with the working group on the inventory of legislation, the Cabinet of Ministers of the Kyrgyz Republic and judges," said UNDP Senior Advisor on Democracy and Rule of Law, Mr. Zhenishbek Arzymatov.

UNDP assists the Kyrgyz Government in promoting and supporting judicial and legal reform, establishment and development of its new institutions and platforms as well as enhancing legal capacity and access to justice for Kyrgyz citizens.
