Bishkek, June 18, 2020. /Kabar/. At a session of the Jogorku Kenesh (Kyrgyz Parliament) on June 18, MPs considered in the first reading a draft law on amendments to some legislative acts in the field of combating domestic violence.
Initiator of the bill, MP Iskhak Pirmatov said the law was designed to improve the effectiveness of state policy to combat domestic violence, the press service of the Parliament reported.
The draft law is aimed at eliminating the possibility of perpetrator's release from liability for domestic violence and termination of proceedings on the basis of the victim's application for reconciliation; toughening liability for domestic violence under the Code of Misdemeanours by removing the penalty of a fine.
"Articles 75 to 76 of the Code of Misdemeanours are proposed to be classified as public prosecution cases. In this case, the law enforcement agencies will be able to carry out pre-trial proceedings in cases of domestic violence on the basis of reports, received from various sources (neighbors, relatives, etc.), regardless of the application of the victim," added the speaker.
It is proposed to supplement the Criminal Code with a new article 179-1, which establishes liability and a penalty of deprivation of liberty for a period of from five years to seven years and six months for violating the conditions of a temporary protection order that has caused harm to health.
The draft law is submitted for voting in the first reading.
