Kyrgyzstan plans to declare amnesty in connection with 75th anniversary of Victory in World War II

Bishkek, March 12, 2020. / Kabar /. A bill on amnesty in connection with the 75th anniversary of the Victory in the Great Patriotic War is submitted for public discussion from March 12, 2020.

Initiators: Deputies of the Jogorku Kenesh Natalya Nikitenko, Iskhak Masaliev.

According to the document, the purpose and objective of this draft law is to apply amnesty for men, women and minors. It is a socially justified action aimed at providing social, legal and socio-psychological support to men, women and minors.

In accordance with this draft law, it is proposed to release from criminal liability and punishment in the form of deprivation of liberty, as well as from punishments not related to deprivation of liberty:

1) women and minors convicted for the first time for a term of up to 5 years;

2) men over 60 years old, as well as women over 55 years old;

3) persons with disabilities with disabilities of groups I and II;

4) persons who are the sole breadwinner in the family, having at least two minor children or children with disabilities, who have a disability of groups I and II;

5) persons who have committed less serious crimes for the first time.

6) pregnant women;

7) women with many children;

8) women and minors, whose unexpired portion of the sentence on the day this Law enters into force is less than one year.

It should be noted, the importance of the participation of mothers in raising children.

Moreover, the amnesty does not apply to the accused and convicted:

1) to whom an amnesty or pardon was previously applied;

2) to life imprisonment;

3) who committed two or more crimes, if at least one of them does not fall within the scope of the amnesty law;

4) in respect of which compulsory educational or medical measures have been applied;

5) recognized as malicious violators of the sentence serving regime.

2. The amnesty law does not apply to defendants or convicts to whom security measures have been applied (that is, confiscation (seizure) of property has been applied.

3. The law on amnesty does not apply to legal entities in respect of which coercive measures of criminal law have been applied.

In addition, an amnesty should not apply to convicted persons, such as murder, torture, abuse of office, hostage taking, high treason, espionage, violent seizure of power, terrorist act, creation of an extremist organization, corruption, etc.

According to the information of the State Penitentiary Service, today the number of convicts is 6554 men, 427 women and minors 19.
