Bishkek, July 2, 2021 . / Kabar / . The draft law "On Amnesty in connection with the 30th Anniversary of Independence of the Kyrgyz Republic" is submitted for public discussion from July 1, 2021.
Initiators are deputies of the Jogorku Kenesh of Kyrgyzstan.
The draft law provides for exemption from criminal punishment in the form of imprisonment and reduction of the unexpired term of imprisonment for certain categories of persons.
The draft law proposes to exempt following categories of persons:
- men over 60 years old and women over 55;
- persons with disabilities of groups I and II;
- persons who are the sole breadwinner in a family, who have at least two minor children or children with disabilities of groups I and II;
- persons who have committed less serious crimes for the first time.
- women and minors, the unexpired part of punishment of whom is less than one year as of the date of entry into force of this Law.
Meanwhile, this norm does not cover persons who have committed especially grave crimes.
The draft law also proposes to reduce the unexpired term of imprisonment:
1) to those convicted of a less serious crime, the unexpired term of imprisonment by 1/2;
2) to those convicted of a felony - the unexpired term of imprisonment by 1/3;
3) to those convicted of a particularly grave crime - the unexpired term of imprisonment by 1/4.
In the case of adoption of this draft law, the State Service for Execution of Punishment under the Ministry of Justice of Kyrgyzstan predicts that:
- About 1,106 people will be granted amnesty (of which 85 people have outstanding pecuniary claims and 951 are wanted);
- About 3127 persons will be subject to reduction of unexpired terms of punishment (834 persons of them have unexpunged pecuniary claims).
