SAEPF proposes to ratify Paris Agreement

Bishkek, Mar. 22, 2019. /Kabar/. The State Agency for Environmental Protection and Forestry (SAEPF) under the Government of the Kyrgyz Republic submits for public discussion the draft law on The Kyrgyz Republic’s Ratification of the Paris Agreement within the UN Framework Convention on Climate Change, signed on December 12, 2015 in Paris.

According to the background statement, it is proposed to approve the draft law The Kyrgyz Republic’s Ratification of the Paris Agreement within the UN Framework Convention on Climate Change, signed on December 12, 2015 in Paris, developed by the State Agency for Environmental Protection and Forestry under the Government of the Kyrgyz Republic in order to implement the instructions of the Prime Minister of the Kyrgyz Republic of May 19, 2017, №19-1902 and the instructions of the First Vice Prime Minister of the Kyrgyz Republic of March 3, 2018, No. 19-1902.

On December 12, 2015, in Paris, 196 parties to the UN Framework Convention on Climate Change unanimously adopted the Paris Agreement – a new agreement within the UN Framework Convention on Climate Change. The agreement was to replace the Kyoto Protocol and strengthen the activities that countries have under the convention as a whole. The document establishes the basic principles of action of all states.

The Paris Agreement officially entered into force on November 4, 2016.

Objectives of the Paris Agreement:

- Holding the increase in the global average temperature to well below 2°C above pre-industrial levels and pursuing efforts to limit the temperature increase to 1.5°C above pre-industrial levels, recognizing that this would significantly reduce the risks and impacts of climate change;

- Increasing the ability to adapt to the adverse impacts of climate change and foster climate resilience and low greenhouse gas emissions development, in a manner that does not threaten food production; and

- Making finance flows consistent with a pathway towards low greenhouse gas emissions and climate-resilient development.

The Paris Agreement is based on the principle of common but differentiated responsibilities and respective capabilities in the light of different national conditions, that is, it makes a distinction between the obligations of developed and developing countries. At the same time, it does not contain a reference to the lists of countries included in Appendices I and 2 of the Convention, that is, it allows a more dynamic and flexible approach to determining the status of a country under the Paris Agreement. At the same time, the special needs of the least developed states and small island developing states received separate recognition, but there is no previous reference to countries with economies in transition, taking into account the dynamic approach to the division of rights and duties, respectively, of developed and developing states.

In accordance with the Paris Agreement, the Kyrgyz Republic is not a donor country and does not have obligations to assist other countries.

The Paris Agreement uses the temperature goal set by Article 2 – Holding the increase in the global average temperature to well below 2°C above pre-industrial levels and pursuing efforts to limit the temperature increase to 1.5°C above pre-industrial levels, recognizing that this would significantly reduce the risks and impacts of climate change.

The perspective of the Paris Agreement for economically weaker and more vulnerable countries, such as the Kyrgyz Republic, is also related to the possibility of obtaining financial support for both adaptation to negative effects and natural disasters and low-carbon development, which implies a reduction in greenhouse gas emissions.

In 2016, the SAEPF prepared a draft regulaion of the Government of the Kyrgyz Republic on approval of the Paris Agreement w the UN Framework Convention on Climate Change in order to comply with national procedures. The draft has been coordinated with ministries and departments of the Kyrgyz Republic and reviewed in relevant Committees of the Kyrgyz Parliament: the Committee on International Affairs, Defense and Security, the Committee on Agrarian Policy, Water Resources, Ecology and Regional Development and the Committee on Budget and Finance.

The Paris Agreement within the United Nations Framework Convention on Climate Change was approved by the decree of the Government of the Kyrgyz Republic of June 29, 2016, No. 297-p and signed by the Kyrgyz Republic in September 2016 during the 71st session of the UN General Assembly in New York.
