Bishkek, Sept. 23, 2017 / Kabar /. The UN Human Rights Committee considered the individual complaint submitted by Kadyrzhan Batyrov on October 17, 2011 regarding his right to the presumption of innocence.
The press service of the Ombudsman reports that, on the results of consideration, on July 13, 2017, the UN Human Rights Committee concluded that the Committee did not reveal violations of his rights on the part of the Kyrgyz Republic in Kadyrzhan Batyrov's complaint, as Kadyrzhan Batyrov did not justify how a resolution of the parliament (political document) could affect the criminal proceedings in his case.
Moreover, according to the UN Committee, Kadyrzhan Batyrov did not provide any information on the criminal case against him, as well as copies of the court decision of the first instance of October 28, 2011. In addition, he did not complain about possible shortcomings in his trial and did not indicate how the decision of Parliament affected its outcome.
The UN Committee considers Kadyrzhan Batyrov's accusations against the Kyrgyz Republic unfounded. The decision of the UN Committee is final and cannot be appealed.
The Committee did not consider Kadyrzhan Batyrov’s complaint about his alleged discrimination by the state on the basis of ethnicity.
Recall that in May 2010, Kadyrzhan Batyrov was charged with separatism and, in particular, organizing riots.
